Welcome to the Change My School website (the “Site”), and thank you for accessing our services. The Site is owned and operated by CHANGE MY SCHOOL, LLC. Where used in these Terms and Conditions of Use (“Terms”), “we” or “us” refer to CHANGE MY SCHOOL, LLC. These Terms govern your use of the Site or any of our products, software, data feeds, and services provided to you on, from, or through the Site (collectively the “Service”).

Acceptance

By using the Service, you signify your agreement to these Terms and the Privacy Policy. Your participation in any contest or promotion on or through the Site or in connection with the Service signifies your agreement to these Terms and the applicable Official Contest Rules. If you do not agree to any of these Terms please do not use the Service.

We may attempt to notify you of major changes made to these Terms. We may, in our sole discretion, periodically modify or revise these Terms and other documents referenced herein and you agree to be bound by such modifications or revisions.

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms. In any case, you affirm that you are over the age of 13, as the Service is not intended for children under 13.

If you are under 13, we must have express written permission from a parent or guardian before you may use this Site or the Services. The authorizing parent or guardian must sign our parental consent form and either email or mail the form back to us at info@changemyschool.com, or at the address below. This parental consent form certifies the child’s age and parent’s authority, and gives us express permission to acquire and retain any such personal information from you as we may normally obtain from users of the Site or the Services.

General Use of the Service

We hereby grant you permission to access and use the Service as set forth in these Terms, provided that, without limitation:

You agree to use the Service in accordance with these Terms and all applicable laws.
You agree not to alter or modify any part of the Service.
You agree not to access content through any technology or means other than the video playback pages of the Service itself or other explicitly authorized means we may designate.

Accounts

In order to access some features of the Service, you will have to create an account on the Service. You may never use another’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account. Although we will not be liable for your losses caused by any unauthorized use of your account, you may be liable for our losses or the losses of others due to such unauthorized use.

Your Content and Conduct

As a Change My School account-holder, you may be able to participate in promotional events and contests by submitting videos. You understand that we do not guarantee any confidentiality with respect to any content you submit. You agree that any entry will be subject to these terms and the applicable contest or promotional terms.

You shall be solely responsible for your own content and the consequences of submitting and publishing your content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish content you submit; and you license to us all patent, trademark, trade secret, copyright or other proprietary rights in and to such content for publication on the Service pursuant to these Terms. Without limiting the foregoing, you hereby grant each user of the Service a non-exclusive license to access your content through the Service, and to use, reproduce, distribute, display and perform such content as permitted through the functionality of the Service and under these Terms.

You further agree that you will not submit to the Service any content or other material that is contrary to any additional guidelines we may provide on the Guidelines page (which may be updated from time to time) or contrary to applicable local, national, and international laws and regulations. Without limitation, you agree that you will never submit any content containing:

third party copyrighted material;
material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant us all of the license rights granted herein;
materials inappropriate for viewers of all ages (such as sexual content, nudity, depictions of dangerous or illegal acts, substance use, violence, or harassment);

people who are readily identifiable and who haven’t consented to being filmed;

License

Change My School, LLC authorizes you to copy materials on this site to a hard drive for the purpose of viewing and using the site on your computer or mobile device. You may also print portions of the site in hard copy for the sole purpose of facilitating your personal, noncommercial use and retention of information from the Service. You may not sell or modify the material or reproduce, republish, display, publicly perform, distribute, or otherwise use the material in any way for any public or commercial purpose. Governing Law and Venue

These Terms shall be interpreted, construed and governed by the laws of the State of Washington, USA, without reference to its laws relating to conflicts of law and not including the provisions of the 1980 United Nations Convention on Contracts for the International Sale of Goods. Venue for all disputes arising under this Agreement shall lie exclusively in the Superior Courts of the State of Washington in King County or the Federal District Courts of the Western District of Washington (as permitted by law) and each party agrees not to contest the personal jurisdiction of these courts. Notwithstanding the foregoing, however, we shall have the right to commence and prosecute any legal or equitable action or proceeding before any non-U.S. court of competent jurisdiction to obtain injunctive or other relief in the event that, in our opinion, such action is necessary or desirable.

Enforcement

Should any clause of these Terms be found unenforceable, wherever possible this will not affect any other clause and each will remain in full force and effect. Our failure to expressly enforce any provision of these Terms does not waive our rights to enforce that or any other provision.

Modification/Integration

We reserve the right to change these Terms, other documents referenced herein, and other information available on the Services, without notice. These conditions set out the entire agreement between us and you relating to your use of the Site.
